1. Acceptance of These Terms
By creating a VimaPay account or using any VimaPay product, you agree to these Terms of Service. If you do not agree, you may not use VimaPay. We may update these terms from time to time; continued use after an update constitutes acceptance of the revised terms.
2. Eligibility
You must be at least 18 years old and a legal resident of Nigeria, or a country we explicitly support, to use VimaPay. By registering, you represent that the information you provide is accurate and that you are legally permitted to use our services.
3. Account Registration
To use VimaPay, you must create an account using your phone number, full legal name, and a valid Bank Verification Number (BVN). You are responsible for keeping your login credentials, transaction PIN, and one-time passwords confidential.
You agree to notify us immediately of any unauthorised access to your account.
4. Services Offered
VimaPay provides a digital wallet, peer-to-peer transfers, bill payments, gift card purchases, virtual cards, and currency exchange services. Available features depend on your KYC tier and may change as we update the product.
5. User Obligations
You agree to use VimaPay only for lawful purposes. You will not impersonate another person, provide false information, or use the service to launder money, finance terrorism, or evade tax obligations. You will respond promptly to KYC and transaction-monitoring requests.
6. Prohibited Activities
The following are strictly prohibited on VimaPay:
- Fraud, phishing, or any deceptive practice;
- Funding gambling on unlicensed platforms;
- Purchase or sale of illegal goods or services;
- Reverse engineering the VimaPay app or APIs;
- Using VimaPay for commercial-scale unauthorised resale of digital goods.
7. Fees & Charges
VimaPay discloses all applicable fees before you confirm any transaction. Fees may include transfer fees, FX margins, card-funding charges, and third-party biller fees. We reserve the right to update our fee schedule with at least 14 days’ notice via in-app notification or email.
8. Intellectual Property
The VimaPay name, logo, app, website, and all related designs and content are the property of VimaPay Limited. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9. Limitations of Liability
To the maximum extent permitted by law, VimaPay is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Our total liability for any claim related to your use of VimaPay will not exceed the total fees you paid us in the three months preceding the event giving rise to the claim.
10. Termination
You may close your VimaPay account at any time from within the app. We may suspend or terminate your account if we suspect fraudulent activity, violation of these terms, or if required by law or regulators. On termination, we will return any remaining wallet balance via your verified bank account, subject to applicable holds.
11. Governing Law
These terms are governed by the laws of the Federal Republic of Nigeria. Any dispute will be resolved by the courts of Lagos State, except where consumer-protection laws grant you the right to bring action in your local jurisdiction.
12. Changes to Terms
We may revise these terms at any time. Material changes will be notified at least 14 days in advance via the app and email. Continued use of VimaPay after the effective date of any change constitutes acceptance.
